1. Acceptance of Terms
By downloading, installing, or using Kid PB ("the App"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the App.
2. Description of Service
Kid PB is a mobile application that allows parents and guardians ("Recorders") to track their children's personal best performances in physical activities. The App also allows family members ("Observers") to follow children's progress and view leaderboard rankings.
3. Eligibility
You must be at least 18 years old (or the age of legal majority in your jurisdiction) to use the App as a Recorder. The App is designed for parents and guardians to track their children's activities. Children do not create accounts or interact with our servers directly.
Observers must be at least 13 years old to use the App.
4. User Accounts
The App uses anonymous device-based identification. You do not create a traditional account with email and password. Your identity within the App is tied to your device. If you uninstall and reinstall the App, your local data and server-side identity may be lost.
You are responsible for maintaining the security of your device and any share codes you generate.
5. User Content
5.1 Your data
You retain ownership of all data you enter into the App, including child profiles, activity records, attempt values, and notes. We do not claim any ownership or intellectual property rights over your content.
5.2 Shared data
When you enable sharing features (Share with Friends & Family, Participate in Leaderboard), you grant us a limited, non-exclusive license to store, transmit, and display the shared data (child first names, ages, PB values) to authorised recipients (followers, leaderboard participants) for the purpose of operating the service.
You can revoke this license at any time by disabling sharing in Settings. Your shared data will be removed from our servers within 30 days.
5.3 Accuracy
You are responsible for the accuracy of data you enter. The App does not verify the accuracy of recorded personal bests. Leaderboard rankings are based on self-reported data.
6. Acceptable Use
You agree not to:
- Submit false, misleading, or fraudulent PB data to the leaderboard.
- Use the App to harass, abuse, or harm any person.
- Attempt to access another user's data without authorisation.
- Reverse engineer, decompile, or disassemble the App.
- Use the App for any unlawful purpose.
- Create multiple accounts to manipulate leaderboard rankings.
- Share another person's children's data without their consent.
We reserve the right to remove leaderboard entries or suspend access for violations of these terms.
7. Leaderboard
7.1 Participation
Leaderboard participation is optional and opt-in. By joining the leaderboard, you consent to your child's first name, age, region, and PB value being visible to other App users.
7.2 Accuracy and fairness
Leaderboard rankings are based on self-reported data. We do not verify results. We reserve the right to remove entries that appear fraudulent or that violate community standards.
7.3 No prizes
The leaderboard is for informational and motivational purposes only. There are no prizes, awards, or competitive standings associated with leaderboard rankings.
8. In-App Purchases
The App may offer optional in-app purchases (subscriptions or consumable credits). All purchases are processed through the Apple App Store or Google Play Store and are subject to their respective terms and refund policies.
We do not process payments directly. For refunds, contact Apple or Google through their standard refund processes.
9. Privacy
Your use of the App is also governed by our Privacy Policy. Please review the Privacy Policy to understand how we collect, use, and protect your information.
10. Intellectual Property
The App, including its design, code, graphics, logos, and content (excluding user-submitted data), is owned by Kid PB and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our written permission.
11. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
The App is not a substitute for professional athletic coaching, medical advice, or fitness guidance. Always consult qualified professionals regarding your child's physical activities and health.
12. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, loss of profits, or personal injury.
Our total liability for any claim arising from your use of the App shall not exceed the amount you paid for the App or in-app purchases in the 12 months preceding the claim.
13. Data Loss
While we take reasonable measures to protect your data, we are not responsible for data loss due to device failure, operating system updates, app uninstallation, or circumstances beyond our control. We recommend regularly exporting your data using the App's export feature.
14. Termination
You may stop using the App at any time by uninstalling it. We may suspend or terminate your access to server-side features (sharing, leaderboard) if you violate these Terms.
Upon termination, your local data remains on your device. Server-side data will be deleted in accordance with our Privacy Policy.
15. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App. Continued use after changes constitutes acceptance.
16. Governing Law
These Terms are governed by the laws of Australia, without regard to conflict of law principles.
